1. Personal Information

ArtYou requires a member to provide a valid email address and choose a username connected with your site activity. Depending on the services you choose, additional information may be collected, for example: billing or payment information, a telephone number, or a physical address.

You may connect to ArtYou with an external application, in which case ArtYou may receive some information from that other service.

We use browser cookies, clear gifs, log files, and flash cookies to help understand how people interact with our site and services, in order to provide a better experience.



2. Information Collected or Received

ArtYou will not sell or disclose your name, email address or other personal information to third parties without your explicit consent, except as specified in this policy.

As an ArtYou member you are required to provide a valid email address at registration and choose a username or alias that may represent your identity on ArtYou.

Depending on which services you choose to use, ArtYou may require additional information, such as a store name, billing and payment information (including billing address, telephone number), a telephone number, and/or a physical mailing address.

ArtYou may contact individual store owners to confidentially request more information about their stores or items listed on the site, to ensure compliance with our rules. Your username, ArtYou ID or alias is publicly displayed and connected to your ArtYou activity. Other people may see your date joined, feedback, ratings, profile information, items listed for sale, store pages, sold item listings, and comments in community spaces.

ArtYou automatically receives and records some information from your browser when you visit the site, such as your IP address, cookies and data about which pages you visit on the site through the use of log files provided by our third-party tracking-utility partners. This information helps us analyze and understand how the site works for members and visitors, and provide a more personalized experience for members and visitors.

Some members or visitors may connect to or register an ArtYou account using an external third-party application, such as Facebook.

ArtYou may receive some data from those connected third-party applications.

ArtYou may receive or collect information (for example: email address) about a person who is not yet a registered ArtYou member (a “non-member”)  in connection with certain ArtYou features, including but not limited to: a non-member subscribing to an ArtYou newsletter, a member inviting a non-member to visit, a non-member engaging in a transaction. Non-member information is used only for the purpose it was originally submitted to ArtYou. A non-member can contact ArtYou Support if they do not want ArtYou to retain their information.

ArtYou uses the information described in this policy to provide and improve our services and products, for billing and payments, for identification and authentication purposes, to contact members or interested parties, and for general research and aggregate reporting.  

ArtYou’s Terms of Use require all account owners to be at least 18 years of age (or have the permission and supervision of a responsible parent or legal guardian), therefore, this policy does not discuss use of our site or services by minors.

3. Choice & Control

We know members of our community value having control over their own information, and therefore ArtYou gives you the choice of providing, editing or removing certain information, as well as choice over how we contact you.

You may change or correct your ArtYou account information (except your username). You may remove certain optional information you no longer wish to be publicly visible, such as your full name.

For various reasons, ArtYou may contact you about our services or your activity. Some of these messages are required, service-related messages for members. If you have optionally connected your account to an external, third-party application, such as Facebook, you can remove permission for the app by changing your account settings.

If you no longer wish to use ArtYou’s services or receive service-related messages, then you may close your account.

4. Messages from ArtYou

On occasion, ArtYou will contact you. Primarily, messages are delivered by email, and every account is required to keep a valid email address on file to receive messages. In some situations, ArtYou may contact you by telephone, SMS message or physical mail in order to provide you with information about products and features you my find of interest or to provide you with customer support. You may update your contact preferences in your Profile or About page.

Some messages from ArtYou are service-related and required for members. Examples of service-related messages include, but are not limited to: a welcome/confirmation email when you register your account, notification of an order, or correspondence with ArtYou’s support team. These messages are not promotional in nature.

As a member, ArtYou may also send you messages related to certain features on the site or your activity. ArtYou may also send you news or updates about changes to our site or services. By default, members will receive these messages via email.

5. Uses

We use this information to provide and improve our services, and to communicate with you.

ArtYou will not sell or disclose your personal information to third parties without your explicit consent, except as specified in our Privacy Policy.

Members may review and change their information in their account settings, and they may remove certain optional pieces of information.


7. Information Sharing & Disclosure

We want to respect your privacy. ArtYou will not sell or disclose your name, email address or other personal information to third parties without your explicit consent, except as specified in this policy.

ArtYou limits access to your personal information to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.

As part of the buying and selling process, ArtYou will share information between the two members involved in the transaction. You may obtain another ArtYou member's email address, shipping address, payment information, and/or other information. As described in ArtYou's Terms of Use, you have a limited license to use this information only for ArtYou-related communications or for ArtYou-facilitated transactions. ArtYou has not granted you a license to use the information for unsolicited commercial messages. Without express consent from that person, you must not add any ArtYou member to your email or physical mailing list.

ArtYou may release your personal information to a third-party in order comply with a subpoena or other similar legal procedure, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of ArtYou's Terms of Use. We may disclose personally identifiable information to parties in compliance with our Copyright and Intellectual Property Policy, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, ArtYou may disclose name, address, country, phone number, email address and company name.

ArtYou employs other companies and people to perform tasks on our behalf, and we need to share your information with them to provide products and services to you. Examples include but are not limited to fulfilling orders, processing payments, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service. ArtYou may partner with third-party services for fraud prevention and/or identity verification.

When you a load a page on ArtYou that has a social plug-in from a third-party site or service, such as a Like or Send button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site.

We can only speak for ourselves; this policy does not apply to the practices of third parties that ArtYou does not own or control, or individuals that ArtYou does not employ or manage. If you provide your information to others on ArtYou or throughout the Internet, different rules may apply to the use or disclosure of the information you provide to them. ArtYou does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. ArtYou is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the ArtYou site. We encourage you to ask questions before you disclose your personal information to others.

8. Cookies & Tracking Technologies

ArtYou may partner with third-party services who may use various tracking technologies, such as browser cookies or Flash cookies, to provide certain services or features. These technologies allow a partner to recognize your computer each time you visit ArtYou, but do not allow access to personally identifiable information from ArtYou. ArtYou does not have access or control over these third-party technologies, and they are not covered by our privacy statement.

9. Security

The security of your personal information is important to us. Your ArtYou account information is protected by a password. It is important that you protect against unauthorized access of your account and information by choosing your password carefully, and keeping your password and computer secure by signing out after using our services. ArtYou follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once ArtYou receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.


10. Data Retention

ArtYou will retain your information for as long as your account is active or as needed to provide you services.  If you no longer want ArtYou to use your information to provide you services, you may close your account. ArtYou will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

11. Privacy Policy Changes

ArtYou reserves the right to modify this privacy statement at any time, so please review it periodically. We’ll communicate changes by posting a notice on the site. If we make material changes to this policy you will be notified here, by email, or other places ArtYou deems appropriate.
